Bandaging Wounds: Mediation as a Tool for Healing
Integrating restorative practices into a mediation can set parties onto a path of healing. This is a central principle underpinning the work of the Aga Khan Conciliation and Arbitration Board (CAB). This discussion will outline six of the restorative practices employed by CAB USA when seeking to initiate a healing process, i.e. “bandaging wounds” of parties, namely: (i) a consciously empathetic process, (ii) referrals for inter-institutional support services, (iii) self-help resources, (iv) tools for considering the needs of non-party children, (v) a forward-looking end-of-mediation session, and (vi) post-mediation assistance.
Presenter:
Hon. Kamran Jivani volunteers in his personal capacity as a mediator and national board member of the Aga Khan Conciliation and Arbitration Board (CAB). Professionally, he serves as a lead judge of the Patent Trial and Appeal Board at the United States Patent and Trademark Office. Judge Jivani earned a B.S. in Computer Science from the Georgia Institute of Technology, a J.D. magna cum laude from the University of Illinois College of Law, and is a former partner of Alston & Bird, LLP, where his practice focused on complex patent litigation. In the US, CAB mediates over 150 cases per year pro bono using 54 volunteer mediators across the country.
