Typically, the mediation process is fairly opaque to participants. They understand the general purpose and that sessions may take place jointly or in caucus. However, they often do not understand the nature of barriers to resolution, the strategies available to mediators, and why they may be deployed at different junctures. To the extent the mediator is evaluative, participants are often aware of what the mediator has shared with their side, but not necessarily what is shared with the other side. In this presentation, we will explore the potential benefits of a more transparent approach to mediation.
ABOUT THE SPEAKER
LISA RENEE POMERANTZ, a graduate of Harvard University and Boston University Law School, clerked for a federal judge, practiced litigation and then worked for fifteen years as a senior-level in-house counsel for NEC. Currently she practices business and employment law while mediating and arbitrating commercial, consumer and employment disputes for the American Arbitration Association and also serves on the mediation panel and the ADR Advisory Council for the United States District Court for the Eastern District of New York. Lisa has held a variety of leadership roles with the Association for Conflict Resolution, the New York State Dispute Resolution Association and the Suffolk County Bar Association.
A popular speaker at legal and business meetings and conferences, Lisa also publishes an email newsletter, Making the Connection. She has contributed numerous articles to various legal and ADR publications and has also provided on-line and live training for business and legal audiences. She has taught at Touro Law School, New York Law School, the University of Tartu in Estonia and Vilnius University in Lithuania and has received multiple awards for her professional activities. |
